When you are tried in a criminal court and found guilty of a crime by a judge or
jury, you are then sentenced to some period of incarceration. Perhaps you are
convicted and receive a probated sentence. No matter what sentence you receive,
you are entitled to appeal your sentence and conviction to a higher court. Roy
Merrill handles both Texas state and federal appeals. In addition, he handles state
and federal writs of habeas corpus and new trial motions in the state of Texas. Mr. Merrill has
appealed numerous convictions in both state and federal courts of Texas. He
excels at appellate work and enjoys the research and creative aspect of the
work.
The final judgment at the end of your trial is not necessarily the final
determination of your case. Some judgments are reversed or modified in the
appellate courts. If you believe that your case should be reviewed by an
appellate lawyer, you should contact one immediately. As in other legal matters,
the earlier you contact an appellate attorney, the better. Your case could come
to a different conclusion in a higher court.
The appellate process is complicated, lengthy and expensive. Before Roy Merrill
begins to actually appeal a criminal case, he does an extensive evaluation. The
evaluation takes less time and is much less expensive than the actual appeal. In
this evaluation, Roy Merrill thoroughly reads the trial record, investigates all
of the legal proceedings, and reviews all of the evidence presented in the trial
court. The purpose of the evaluation is to identify any errors made by the trial
court, the prosecutor, or the defense attorney, which caused the trial to be
unfair to the defendant. When the evaluation is finished, he will discuss any
possible arguments for a successful appeal and explain in detail the pros and
cons of going forth with an appeal. The evaluation is done for a fixed fee.
Criminal law appeals and post-conviction writs can be sought on many grounds,
such as: Jurisdictional issues and defects, improper jury instructions,
evidentiary matters, hearsay violations, discovery issues, failure of the
district attorney to disclose favorable evidence, legality of arrest and
suppression of evidence obtained as a result of illegal arrest and search, legal
sufficiency of the evidence to support the finding of guilt in the trial court,
validity of the indictment, unconstitutional statute, discriminatory selection
of grand jurors, legality or admissibility of confessions, errors which occur
during voir dire or selection of the jury, improper identification of the
accused, different violations of the Rules of Evidence and the Code of Criminal
Procedure, errors by the trial court in the court’s instructions to the jury as
to the defense law which applies to the case, improper jury argument by the
prosecutor, denial of right to speedy trial, excessive bail, and many other
legal issues that may result in a conviction being overturned or reversed on
appeal.
Although difficult to do, sometimes it is even possible to successfully appeal
and set aside or reverse a conviction which has resulted from a guilty plea. In
several cases, Roy Merrill has obtained a new trial for a client who, while
being represented by a different lawyer, entered into a plea bargain deal, pled
guilty in court and received a conviction.
